Compliance Considerations
When a debtor files for bankruptcy, federal law provides specific protections that affect collection activities:
- Automatic Stay: Upon filing, an automatic stay goes into effect that generally prohibits collection activities
- Proof of Claim Deadlines: Monitor the Proof of Claim Date to ensure timely filing with the bankruptcy court
- Discharge Status: A discharged debt is no longer legally collectible from the debtor personally
- Chapter Differences: Different bankruptcy chapters have varying implications for debt collection
- Attorney Communications: When a debtor has legal representation, direct all communications through their attorney
Always consult with your legal team regarding proper procedures when handling accounts in bankruptcy.
